Welcome to Barsociety. The Barsociety website and service are provided by Barsociety Pte. Ltd. (“Barsociety”, “we” “us” or “our”). These terms of service (these “Terms”) govern your (“you”, “your”, or a “user”) access to and use of the Barsociety’s social membership platform (“ Barsociety Platform”), http://www.barsociety.com web site and its subdomains (the “Website”) and all services provided by Barsociety (collectively, including the Barsociety Platform and the Website, the “Services”).
The Services, include but are not limited to (i) the receiving of text reminders from the respective Barsociety participating bars (“the Participating Bars”) informing users of their bottles of liquor which they have purchased and stored at the Participating Bars (“the Bottle Reminder Service”), (ii) the viewing of a user profile page (“Bottle Profile”) on the Website that sets out all bottles of liquors users have purchased and the percentage of the bottle remaining, and (iii) provide relevant updates, offers and invitation to events from the respective Barsociety participating bars via SMS, ((ii) and (iii) collectively “the Bottle Membership Service”).
Please read these Terms carefully as they create a binding contract between you and Barsociety. By creating an account with Barsociety (“ Barsociety Account”) and using the Services, you represent that you are at least 18 years old and you are deemed to have read, understood and accepted the terms and conditions of these Terms and the Privacy Policy found here. Please review these Terms before using the Services, as they may have changed since your last visit. If you do not agree to these Terms, then you must immediately terminate your membership with Barsociety and discontinue your use of the Website and the Services. Your continued use of the Services after any changes or revisions of these Terms shall indicate your agreement with the revised Terms.
We reserve the right to change these Terms from time to time for any reason, which shall be effected by the posting of the updated Terms to our Website. Access to the Website and use of the Services are subject to these Terms and the Barsociety Privacy Policy available on the Website.
Other than providing the platform to enable the use of the Services, Barsociety will not be responsible for the manner in which the Participating Bars collect your Personal Data (as defined in the Privacy Policy). Barsociety does not manage or monitor the collection of Personal Data done by the Participating Bars.
In creating a Barsociety Account, you are agreeing to give your consent for Participating Bars to collect your Personal Data, including but not limited to your name and phone number, and pass it on to us in order to provide the Services.
Barsociety will only use your Personal Data for the provision of the Services. Personal Data provided to Barsociety will protected to the extent afforded by the Singapore Personal Data Protection Act 2012 (Act No. 26 of 2012) (“PDPA”) and in accordance with Privacy Policy.
Upon purchasing a bottle of liquor at any Participating Bars, you choose whether you would like to create a Barsociety Account in accordance with these Terms by providing your name and phone number to Barsociety. Upon creation of the Barsociety Account, you will become a Barsociety Member and you would have subscribed for the following Services:
1. The Bottle Reminder Service: receiving of text reminders from the respective Barsociety Participating Bars informing them of you of the bottles of liquor which you purchased at the respective Participating Bar; and
2. The Bottle Membership Service: a collective view of your Bottle Profile, being all bottles of liquors purchased at all Participating Bars and the level of the bottle remaining for each respective bottle.
After creation of the Barsociety Account, a text message will be sent to your mobile number. In the text message, you will be provided with the unique weblink to view your Bottle Profile. Prior to being able to access your Bottle Profile, you will be required to enter the last 4 digits of your mobile number.
You may unsubscribe from the Bottle Reminder Service and/or the Bottle Membership Service at any time.
We may alter, suspend, or discontinue the Services in whole or in part, at any time and for any reason, without notice, subject to the terms of any applicable written agreement. The Services may also periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons.
If you use our Website on your mobile phone, your mobile carrier’s normal rates and charges apply. We are not responsible for any charges you incur from your mobile carrier as a result of use of the Services. You are responsible for ensuring that at all times while using the Service you are not in violation of your wireless data service agreement.
Barsociety expressly disclaims any liability or claims that may arise between Participating Bars and Barsociety Members in the course of the collection and use of the Personal Data (“the Interaction”) for the purpose of the providing the Services.
As Barsociety is not responsible for the Interaction between the Participating Bars and the Barsociety Members. In the event that you have a dispute with one or more of the Participating Bars, you hereby release Barsociety (and our officers, directors, agents, investors, subsidiaries, and employees) from any and all claims, demands, or damages (actual or consequential) of every kind, known and unknown arising out of or in any way related with such disputes.
By using our Services, you agree to indemnify, hold harmless and defend Barsociety and its officers, directors, employees and agents from any claims, damages, losses, liabilities, and all costs and expenses of defense, including but not limited to, attorneys' fees, resulting directly or indirectly from a claim by a third party that arises in connection with your use of the Services.
The Services may contain links to non-Barsociety websites, whether for marketing purposes or otherwise. These links are provided to you as a matter of convenience, and Barsociety is not responsible for the content of any linked web site. Any non-Barsociety website accessed from the Services is independent from Barsociety, and Barsociety has no control over the content of that website. In addition, a link to any non-Barsociety website does not imply that Barsociety endorses or accepts any responsibility for the content or use of such website. Use of any third party site is subject to its term of service and privacy policy. We request that our users exercise caution and good judgment when using third-party websites.
Under no circumstances will we be liable for any loss or damage caused by your reliance on information on any information communicated via text for the purposes of the Bottle Reminder Service, or any information contained in your Barsociety Account for the purposes of the Bottle Membership Service. The information provided to us by the Participating Bars for the purposes of providing the Services is accurate
ALL CONTENT AND INFORMATION ON OR ACCESSIBLE FROM OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SPECIFICALLY, BUT WITHOUT LIMITATION, BARSOCIETY DOES NOT WARRANT THAT: (I) THE INFORMATION AVAILABLE ON OUR SERVICES IS FREE OF ERRORS; (II) THE FUNCTIONS OR SERVICES (INCLUDING BUT NOT LIMITED TO MECHANISMS FOR THE DOWNLOADING AND UPLOADING OF CONTENT) PROVIDED BY BARSOCIETY WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS; OR (III) DEFECTS WILL BE CORRECTED.
Barsociety is not responsible for the Interaction between you and the Participating Bars. Barsociety cannot and does not guarantee that any Personal Data supplied by you will not be misappropriated, intercepted, deleted, destroyed or used by others.
Disclaimer - In no event shall barsociety be liable to you, any other user of our services or any other person or entity for any direct, indirect, special, incidental, consequential or exemplary damages (including, but not limited to, damages for loss of profits, loss of data, loss of use, or costs of obtaining substitute goods or services) arising out of the use, inability to use, unauthorized access to or use or misuse of the services, questions & comments, content or any information contained thereon, whether based upon warranty, contract, tort (including negligence), or otherwise, even if Barsociety has been advised of the possibility of such damages or losses.
We make no representation that information on this Website is appropriate or available for use outside Singapore. Those who choose to access this Website from outside Singapore do so on their own initiative and at their own risk and are responsible for compliance with applicable local laws. By using our Services, you consent to having your Personal Data (as defined in our Privacy Policy posted on our Website) transferred to and processed in Singapore, subject to the restrictions on such data as provided in our Privacy Policy posted on our Website as amended from time to time.
We may terminate your Barsociety Account and access to our Services, in our sole discretion, for any reason and at any time, upon electronic notice to you at the e-mail address provided by you when you registered for your Barsociety Account. Similarly, you also have the option to terminate your Barsociety Account. If you choose to do so, you may terminate your account within the website.
These Terms shall be governed by and construed according to the laws of Singapore and subject to the exclusive jurisdiction of the Singapore Courts. In the event any dispute arising out of or in connection with these Terms including any question regarding its existence, validity or termination, the Parties shall at first instance take reasonable efforts to settle and resolve such disputes in good faith and in an amicable manner by negotiation.
Barsociety Services are available only to, and may only be used by, individuals who are eighteen (18) years and older who can form legally binding contracts under applicable law and of the applicable legal age to purchase and consume alcohol. If a person below the age of eighteen (18) years of age is found to be using the Services, and Personal Data has been transmitted to us, Barsociety shall take the necessary steps to remove the Personal Data collected and terminate the Barsociety Account and the accompanying Barsociety Account provided.
