PERSONAL DATA PROTECTION POLICY

1. INTRODUCTION AND SCOPE OF THIS PERSONAL DATA PROTECTION POLICY

This Personal Data Protection Policy (“Personal Data Protection Policy” or “Policy”) supplements our Terms of Service and explains how Barsociety Pte. Ltd. (including its affiliates and related corporations) (collectively, “Barsociety”) may collect, use, disclose, or otherwise process your Personal Data, in accordance with Singapore’s Personal Data Protection Act 2012 and its subsidiary legislations and regulations as may be amended from time to time (“Applicable Laws”).

This Personal Data Protection Policy supplements but does not supersede nor replace any other consents you may have previously provided to Barsociety in respect of your Personal Data, and your consents herein are additional to any rights which Barsociety may have at law to collect, use or disclose your Personal Data.

As part of our efforts to ensure that we properly manage, protect and process your Personal Data, we may from time to time update this Policy to ensure that this Policy is consistent with industry trends and/or any changes in the Applicable Laws.

2. DEFINITIONS

For the purposes of understanding the Personal Data Protection Policy, capitalised terms used in this Policy shall have the following meanings:

“Applicable Laws” has the meaning set out in Paragraph 1 above;

“Barsociety, we, us, or our” means Barsociety Pte Ltd and its affiliates and related corporations;

“Barsociety Account” means your account created and maintained with Barsociety, on the terms and subject to the conditions set out in the Terms of Service;

“Barsociety Member” means the holder of a Barsociety Account;

“Linked Sites” has the meaning set out in Paragraph 11 below;

“Participating Bar” means any one of Barsociety’s partner bars whom have downloaded and signed up for an account under the BarOS App;

“Personal Data” means any information about you, from which you are identifiable, including but not limited to your name, nationality, address, telephone number, bank details, credit card details, gender, resident status, financial background, personal interests, email address, occupation, photo and any other information about you which may be provided by you to Barsociety or the Participating Bar in registration forms, application forms or any other similar forms and/or requests for information that have been or may be collected, stored, used and/or processed by Barsociety or the Participating Bars from time to time, and includes sensitive personal data such as your identification card number, driving licence number, birth certificate number, passport number, race, ethnic origin, date of birth, marital status, education background, credit rating / score and data relating to health, religious or other similar beliefs; “SMS” means short messaging system;

“Unique Weblink” means the unique weblink provided to you by way of SMS or other electronic communication methods upon the creation of your Barsociety Account;

“Website” means the Barsociety website accessed at the following address: www.barsociety.com and any of its subdomains or subpages.

3. COLLECTION OF PERSONAL DATA

In addition to the Personal Data provided by you to Barsociety directly through the creation of your Barsociety Account, Barsociety may collect your Personal Data as follows:

(a) through or from Participating Bars you have patronized;

(b) when you use our Services or Website;

(c) when you accept our cookies on your device;

(d) when you interact with our customer experience team or other representatives via our Website, email, telephone calls, letters, or face-to-face meetings; or

(e) when you voluntarily submit your Personal Data to Barsociety for any other reason.

4. PURPOSES OF PROCESSING PERSONAL DATA

Barsociety may use and process your Personal Data for the business and activities of the Barsociety which shall include, without limitation the following (the “Purposes”):

(a) to provide you with any Services pursuant to the Terms of Service;

(b) to process, manage or verify details in your Barsociety Account, including but not limited to verifying your age or identity;

(c) to develop, enhance and provide what is required pursuant to the Terms of Service herein to meet your needs;

(d) to understand and analyse your needs and preferences in relation to the Services pursuant to the Terms of Service herein;

(e) to enhance Barsociety’s processes, advertising, notifications, authentication, security and compliance, analytics and preference management;

(f) to facilitate or enable any checks as may be required pursuant to the Terms of Service;

(g) for internal administrative purposes, such as auditing and/or database records;

(h) for purposes of data or market analysis;

(i) for purposes of detection, prevention and prosecution of crime;

(j) to maintain the safety and security of the Services;

(k) to provide you with supporting services and functions related to your Barsociety Account;

(l) to monitor and enforce compliance with our Terms of Service, including dispute resolution;

(m) for Barsociety, its officers, employees, directors, authorised representatives and agents to comply with their obligations under law.

5. ADDITIONAL PURPOSES OF PROCESSING PERSONAL DATA

Barsociety may also use and process your Personal Data for the following additional purposes (“Additional Purposes”):

(a) to send you alerts, newsletters, updates, mailers, promotional materials, special privileges, festive greetings from Barsociety, its partners, sponsors or advertisers;

(b) to notify and invite you to events or activities organized by Barsociety, its partners, sponsors or advertisers; and

(c) to process your registration to participate in or attend an event or activity and to communicate with you regarding your attendance at the event or activity,

(d) to conduct market and customer research, analysis or tracking; and

(e) for any specific purpose in relation to a particular product or service, which we may separately notify you on, by way of telephone call, SMS, and/or by email.

6. REQUEST TO WITHDRAW CONSENT

If you wish to withdraw your consent to the processing of your Personal Data for the Additional Purposes, you may do so by following the unsubscribe link in the Unique Weblink or by way of sending an email to support@barsociety.com.

Depending on the nature of the consent withdrawal, we may not be able to continue to provide you with some or all of our Services. We will process such a request within a reasonable time from receiving your notice of withdrawal of consent. Once the processing is complete, we will no longer collect, use and/or disclose your Personal Data, save for compliance, regulatory or other legal purposes.

7. PROTECTING YOUR INFORMATION

We shall store your Personal Data for as long as it is necessary to provide you with the Services. We may store your Personal Data in servers outside of Singapore. We will take all reasonable steps to ensure that your Data is stored in a manner which meets the standard required under the Applicable Laws.

8. DISCLOSURE TO THIRD PARTIES

Your Personal Data may be transferred, accessed by or disclosed to various third parties for the Purposes listed herein, the Additional Purposes (if applicable), or if the said third parties are engaged by Barsociety to perform various functions on its behalf. The third parties include, without limitation:

(a) Barsociety’s partners and vendors, which include parties with whom Barsociety collaborates with for certain events, programs and activities;

(b) Barsociety’s service providers, including information technology (IT) service providers for infrastructure, software and development work;

(c) Barsociety’s professional advisors and external auditors, including legal advisors, financial advisors and consultants;

(d) governmental authorities to comply with any statutory, regulatory and governmental requirements;

(e) the Singapore courts for purposes of any legal proceedings;

(f) other corporate entities in connection with a corporate transaction, such as a potential joint venture, sale of a subsidiary or a division, merger, consolidation, or asset sale; and

(g) in the event Barsociety is wound-up, Barsociety’s liquidator and creditors.

9. ACCESS & CORRECTION REQUESTS AND INQUIRIES, LIMITING THE PROCESSING OF PERSONAL DATA

Subject to any provisions to the contrary under the Applicable Laws, you may request for access to and/or correction of your Personal Data, to limit the processing of your Personal Data for the Additional Purposes and/or make any inquiries regarding your Personal Data by contacting us at support@barsociety.com.

Subject to the Applicable Laws, Barsociety reserves the right to impose a fee for access of your Personal Data in the amounts as permitted therein.

In respect of your right to access and/or correct your Personal Data, Barsociety has the right to refuse your requests to access and/or make any correction to your Personal Data for the reasons permitted under law, such as where the expense of providing access to you is disproportionate to the risks to your or another person’s privacy.

10. COOKIES AND OTHER TECHNOLOGIES

Cookies are small data files which are placed on your device when you visit certain parts of the Website and the Unique Weblink.

The Website and the Unique Weblink are designed to use cookies to collect information about how you use the Website and the Unique Weblink. Most web browsers are initially set up to accept cookies. You can choose to ‘not accept' cookies by changing the settings on your web browser. However, if you block all cookies, including essential cookies that are set throughout the Website and the Unique Weblink for the operation of the Website and the Unique Weblink, you may find that certain features on the Website and the Unique Weblink will not work properly.

11. DISCLAIMER REGARDING THIRD PARTY SITES

The Website and/or Unique Weblink may from time to time, contain links to external sites or resources which are operated by independent third parties (“Linked Sites”). These Linked Sites are provided solely as a matter of convenience, and Barsociety does not monitor or investigate such Linked Sites. Barsociety accepts no responsibility or liability for any loss arising from the content or accuracy of this material and any opinion expressed in the material should not be taken as an endorsement, recommendation or opinion of Barsociety. This Policy does not extend to your use of such Linked Sites. You are advised to read the privacy policy or statement of such Linked Sites prior to using them.

12. AMENDMENTS TO THE DATA PROTECTION POLICY

Barsociety reserves the right to amend the terms of this Policy from time to time and at Barsociety’s sole discretion. Subject to any rights that you may have at law, you agree to be bound by the prevailing terms of the Data Protection Policy as updated from time to time on the Website. Your continued use of this Website, Unique Weblink and/or our Services after the Policy has been amended shall imply that you are aware of the changes in this Privacy Policy and shall constitute your deemed acceptance of such amendments.

13. GOVERNING LAW

This Policy shall be governed by and construed according to the laws of Singapore and subject to the exclusive jurisdiction of the Singapore Courts. In the event any dispute arising out of or in connection with this Policy including any question regarding its existence, validity or termination, the Parties shall at first instance take reasonable efforts to settle and resolve such disputes in good faith and in an amicable manner by negotiation.
